IT IS ORDERED and Notice is given that on August 3, 2022 at 10:00 am, a remote hearing will be held via Zoom before the honorable Geoffrey W. Tenney, Wright County District Court, to consider the June 20, 2022, Resignation of First Fiduciary Corporation as Trustee of the Gilbert M. Darkenwald Trust (the “GMD Trust”) in the above-captioned action, which shall become effective upon the appointment of a Successor Trustee of the GMD Trust, as well as the pending Motion of Petitioner Casey Darkenwald, in which Petitioner seeks to invoke the in rem jurisdiction of this Court, for the appointment of the GBP Trust Company, LLC to be the Successor Trustee of the GMD Trust (the “Appointment Motion”).
IT IS ALSO ORDERED that the hearing shall be heard via Zoom. A copy of the Court’s Notice of Remote Zoom Hearing dated June 22, 2022 is attached hereto with instructions regarding how interested parties in the GMD Trust may join the August 3, 2022, remote hearing.
IT IS FURTHER ORDERED that Notice of this Order shall be served via publication and mail pursuant to Minn. Stat. § 501C.0203, subd. 1 on all interested parties by Petitioner Casey Darkenwald.
IT IS FURTHER ORDERED that an Objection to the Appointment Motion must be filed with the Court and served on all interested parties in the GMD Trust prior to the August 3, 2022, referenced hearing and/or raised orally at the August 3, 2022, hearing.
IT IS FURTHER ORDERED that if no Objections are served and filed and/or raised at the August 3, 2022, hearing, the Court may enter an Order accepting First Fiduciary Corporation’s resignation as Trustee of the GMD Trust and appointing a Successor Trustee of the GMD Trust. Dated July 1, 2022
